1.1 Who We Are
Shingle LLC is a technology company headquartered in Austin, Texas USA, which focuses on providing technology services to independent, accredited engineers and the business entities that need their engineering services.

1.2 Who and What this Privacy Policy Covers
This Privacy Policy is applicable to Shingle LLC (“Shingle”, “we,” “our,” or “us”) as related to our Services, which collectively includes:

the use of our products and services.
This Privacy Policy sets out Shingle’s policy with respect to information, that is collected from:

A user of Shingle’s Services, including an Evaluator under the Pre-Release Software Agreement (“User”); this includes a User with the role of obtaining or seeking to obtain engineering services from the Consultant (“PM”) or a User with the role of providing or seeking to provide engineering services to a PM (“Consultant”);

A prospective User;
-
A job applicant; or
-
Partners.
1.3 Types of Information and Data Collected
Personal Information: While using Shingle’s Services, Shingle may require or otherwise collect information that identifies you as a specific individual and can be used to contact or identify you (“Personal Information”). Without limitation, this Personal Information may include payment information, such as credit card or other financial account information, and billing address. This Personal Information may also include verification of your identity or licensure. Any data you provide related to your race, sexuality, or religion will also be treated as Personal Information.
Non-Identifying and Aggregate Data: We also may collect other information, such as zip codes, demographic data, information about your use of the Service, and general project-related data (“Non-Identifying Data”). We may also combine information collected from other Shingle Users (“Aggregate Data”). In some cases, we may render Personal Information into Non-Identifying Data in the form of code that does not identify you directly, but it may be used to connect your activity, location, and interests.
2.0 Information We Collect
2.1 Information You Provide to Us

We collect Personal Information and Non-Identifying Data from you when you provide this information to us, such as when:

You request a free trial or demo.

You connect with us directly via phone calls or video conferencing platforms.

If you choose to provide us with a third-party’s Personal Information (the person’s name, email and company) when taking part in our referral program, you represent that you have the third-party’s permission to do so.
WHAT
We collect Personal Information that may include first and last name, years of engineering experience, professional licensure information, business email address, phone number, and/or company name.
We collect Users’ names, business email addresses, and any comments Users make on Shingle. We also collect education information, professional licensure information, and previous experience information for Consultants. For a PM, we collect the market verticals of firm services.
In addition, we may collect data uploaded by you, your employer, or other users of Shingle. We expect all Users to follow their organization’s privacy policy and any applicable regulatory requirements when uploading, accessing, and sharing Personal Information on Shingle’s application or website. The data uploaded may include Personal Information like:

Employee names, email addresses, and contractual agreements;

Vendor names, email addresses, contractual agreements, or other Personal Information about vendors;

Customer names and email addresses used to provide services; and
-
Documentation necessary to describe the scope of work needed to submit a proposal on work or complete work facilitated by the Shingle platform.
Please note that sometimes we may record a video conferencing call in which you participate to analyze and improve our staff’s skills and our Services. If we do so, we will be announcing it at the beginning of the conference call.
If you are a job applicant, we may also collect your resume and cover letter.
2.2 Information We Collect Automatically
WHEN
We collect information about your visits to the website and the application when you land on any of our web pages through cookies and similar tracking technology. This information is largely Non-Identifying Data but does include some Personal Information.

Usage. Shingle also collects data concerning your use of Shingle’s services, including:

Transactions. Shingle collects information about Shingle projects and transactions between or among Users. If you use Shingle to contract for services and/or make or receive payments for services, we collect information about the transaction and the project involved. This includes details of the job or task, deliverables, communications about the project, parties involved, and the number of transactions completed by and between the parties. This also includes payment information, such as your credit or debit card number and other card information, other account and authentication information, and billing and contact details.
Messaging on Shingle. We may collect information when you open messages from us or other Shingle Users via email or the Shingle website or click on links within those messages. We may also collect data from the content of the messages exchanged on Shingle or sent to us via email.
Things others do and information they provide about you. We also receive and analyze content, communications, and information that other Users provide when they use Shingle. This can include information about you, such as when other Users share your profile or task, send a message to you, or download your profile, task, or contact information.
3.0 How We Use Data We Collect
3.1 Personal Information
We use your Personal Information to:

Deliver the Services and allow full use of the application and website functionality.

Deliver training and support to our application Users and/or carry out the transactions you have requested.

3.3 No Sale of Information

4.0 How We Share Personal Information
4.1 Agents, Business Partners, and Investors
Research may be compiled and analyzed on an aggregate basis. Shingle may share this Non-Identifying and Aggregate Data with its agents, business partners, or investors. Aggregated Data, such as user statistics, may also be disclosed to prospective agents, business partners, and investors.
4.2 Our Application and Services
If you are a User, your Personal Information may be viewed by other users with access to the application. We share Personal Information with other Users when you voluntarily disclose information on the Shingle website or application.
Profile. By creating a profile on Shingle, you expressly consent to Shingle sharing the information in your profile, including any photos, on Shingle’s website and app. Information you share in your profile as a Consultant will be accessible to all PMs and may be shared or downloaded by PMs without notice. You understand that your Consultant profile, and the Personal Information therein, may also be shared by Shingle with website visitors, prospective Users, and other third parties.
Job Postings. By creating a job posting or task, a PM expressly consents to Shingle sharing the job posting or task with verified Consultants and acknowledges that the Personal Information therein will be accessible to verified Consultants and may be shared or downloaded by these Consultants without further notice.
4.3 Service Providers
We use third parties to perform certain functions to help us provide our services. Examples of such functions include maintaining databases, ID verification, performing analytics, processing applications, processing payments, and completing transactions. When we employ another company to perform a function of this nature will have access to your Personal Information as collected by the website or the application, as reasonably necessary to perform the contracted tasks on our behalf. These companies are authorized to use your Personal Information only as necessary to provide these services to us. While we take reasonable measures to ensure that our third-party service providers keep your information secure, these organizations’ practices are beyond our control. You acknowledge that you understand and agree to assume these risks.
We may also share certain Non-Identifying Data with these service providers in connection with the services they provide to us.
4.4 Legal Disclosures
It is possible that we may need to disclose Personal Information when required by law, subpoena, or other legal processes as identified in the applicable legislation.
We attempt to notify our Users about legal demands for their Personal Information when appropriate in our judgment unless prohibited by law or court order or when the request is an emergency.
4.5 Change in Control
As we develop our business, we might sell or buy businesses or assets. In the event of a corporate sale, merger, change in control, dissolution, or similar event or in preparation for any of these events. Personal Information and Non-Identifying and Aggregate Data may be part of the transferred assets. If Personal Information is part of the transferred assets, you will be notified via email and/or a prominent notice on our website of any change in ownership or uses of your Personal Information, as well as any choices you may have regarding your Personal Information.
Any other entity that buys all or part of our business will have the right to continue to use your data, but only in the manner set out in this Privacy Policy unless you agree otherwise.
5.0 How We Secure Personal Information
We are committed to protecting the security of all of the Personal Information we collect and use. We use a variety of physical, administrative, and technical safeguards designed to secure your Personal Information from unauthorized access, theft, manipulation, alteration, destruction, or any other change from its original form. We have implemented best-practice standards and controls in compliance with internationally recognized security frameworks. We use encryption technologies to protect data at rest and in transit.
6.0 Your Rights
6.1 Accessing, Changing, and Deleting Personal Information
For Personal Information we have about you:

If you are a User, you may access, update, or correct your Personal Information in your user account or on your profile;

You have the right to obtain information about what Personal Information we process about you; and

You have the right to request the deletion of your Personal Information at any time by contacting info@shingleit.com. We will communicate back to you within reasonable timelines the result of your request. We will retain and use your Personal Information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements, but barring legal requirements, we will seek to delete your Personal Information within 30 days. If we are not able to delete or erase your Personal Information within 30 days, we will inform you of the reasons we are unable to do so and any further actions available to you.
6.2 Selecting your Communications Preferences
You may choose to receive or not receive marketing communications from us. Please click the “Unsubscribe” link in the email we sent you to stop receiving marketing communications.
You may choose which information we collect automatically from your device by controlling cookie settings on your browser.
Even if you opt out of receiving marketing communications, we may still communicate with you regarding security and privacy issues, servicing your account, fulfilling your requests, or administering any promotion or any program in which you may have elected to participate.
7.0 How Long We Keep Your Personal Information
We retain information as long as it is necessary to provide the Services to you and our Users, subject to any legal obligations to further retain such information.
We may also retain information to comply with the law, prevent fraud, collect fees, resolve disputes, troubleshoot problems, assist with investigations, enforce our Terms of Service and take other actions permitted by law.
The information we retain will be handled following this Privacy Policy.
Information connected to you that is no longer necessary and relevant to provide our services may be de-identified or aggregated with other Non-Identifying Data. This information may provide insights that are commercially valuable to Shingle, such as statistics on the use of the Services.
8.0 Other Important Information
We process data in locations of AWS West Region and rely on legally-provided mechanisms to lawfully transfer data across borders, such as contracts incorporating data protection and sharing obligations.
When you visit our website and provide us with your Personal Information, we collect and use it with your consent.
You consent to our collection of your Personal Information and Non-Identifying Data when you log in for the first time. It is your responsibility to ensure that collecting, using, and sharing the Personal Information uploaded to the application complies with all applicable legislation.
Shingle’s Services are not directed toward persons under 18. If a parent or guardian becomes aware that his or her child has provided us with Personal Information without their consent, please contact us at info@shingleit.com and we will take reasonable steps to remove such data from our systems.

We will need to verify your identity before processing your request.
In order to verify your identity, we will generally require sufficient information from you so that we can match it to the information we maintain about you in our systems. Sometimes we may need additional Personal Information from you to be able to identify you. We will notify you.
We may decline a request to exercise the right to know and/or right to deletion, particularly where we cannot verify your identity or locate your information in our systems or as permitted by law.
You may choose to designate an authorized agent to make a request under the CCPA on your behalf. No information will be disclosed until the authorized agent’s authority has been reviewed and verified. Once an authorized agent has submitted a request, we may require additional information (i.e., written authorization from you) to confirm the authorized agent’s authority.
If you are an employee/former employee of a Shingle LLC User that uses our application and services, please direct your requests and/or questions directly to your employer/former employer.
If you are a third party (auditor, business associate, etc.), who was given access to the Shingle LLC application by a Shingle LLC User, please direct your requests and/or questions directly to the Shingle LLC User that gave you access.
